Acharya case: SC asks TN police to pinpoint evidence

New Delhi, Jan. 6. (PTI): The Supreme Court, which began hearing on the Kanchi Sankaracharya's bail plea in the Sankararaman murder case, today repeatedly asked the Tamil Nadu police to "pinpoint" the evidence linking the seer to the offence.

Repeated queries by a Bench headed by Chief Justice R C Lahoti evoked little response from the counsel for the Tamil Nadu Government which is opposing the bail.

"We only want to know whether you have a case against the Sankaracharya and if so, what are the pieces of evidence against him, apart from the motive arising from the letters written by the deceased levelling wild allegations against the pontiff," the Bench asked.

Appearing for the Tamil Nadu Government, K T S Tulsi, who handed over the case diary and other evidence in a sealed cover, said the prosecution has "direct evidence" linking the seer to the conspiracy to kill Sankararaman.

The arguemnts would continue in the afternoon.

Appearing for Sankaracharya, senior advocate Fali Nariman sought to drill holes in the prosecution theory linking the seer to the murder and said even on basic facts like payment of money to the assailants, the Tamil Nadu police has been changing its stand.

Appeal in Supreme Court

Special leave petition against the order of the Madras High Court in CRL OP Number 36748 of 2004 filed in the Supreme Court. Posted for hearing on Friday December 17, 2004.

Reliefs claimed:

1. Stay the operation of the High Court Order

2. Release His Holiness on bail

3. Without prejudice to the above His Holiness may be allowed to be in the Kanchi Mutt and permitted to perform the religious activities and reside in the Mutt.

Padmabhooshan Fali K. Nariman, Member of Parliament and eminent jurist would appear on behalf of His Holiness. Shri. S. Venkiteeshwaran, of Mumbai, Senior Advocate Supreme Court and several other eminent senior legal experts form part of the legal team.

Special sloka to be chanted during this period

A devotee has sent the 129 th sloka from Sri Sudarsana Sahasranama Sthothram, to be recited a minimum of 10 times during the period of the case. Devotees may increase the number to 108 or 1008 based on their convenience. This particular sloka is recommended particularly for attaining success in court cases.
