PETITION FILED ON BEHALF OF THE PETITIONER/ACCUSED
The petitioner submits that he is a Religious Head and Madathipathi of Kanchi Kamakoti Peetam. He is aged about 70 and suffering from Diabetes and High Blood Pressure. The Petitioner being a Religious Pontiff and Sanyasi has to perform his daily rituals and take sanctified food according to Hindu Religious Tenets. The Petitioner also is in custody of Police from Mahaboob Nagar, State of Andhra Pradesh from 2.00P.M. (11.11.2004) onwards. He had no sleep and he is in continuous travel and weary and in a shocked state of mind. The Petitioner is innocent of the offence alleged by the police against him and there is no prima facie evidence for any remand.
The Petitioner submits that if this honourable court decides to remand,
in view of the above factors of age, health and the position of the petitioner,
this court may be pleased to admit him in a Hospital or in a private nursing
home for routine medical check up and treatment as he is an insulin dependant
person, who has to take injections and tablets daily.
The Petitioner submits that if the police seek police custody of this petitioner
for vindictive purpose, this court may for the above said reasons reject
the same. This court may also take into consideration the right of the
petitioner
to have legal assistance and if such police custody is given permit his Advocate
to be present at the time of interrogation and permit his counsel to be present
at a hearing distance and render justice.
