Mutt Attorney pounces on Tamil Nadu Government

With much ado, Jayendrar has finally gotten bail. But even after this, the TN government won’t leave him be. They have moved the Supreme Court that “Jayendrar must be ordered not to remain in the Southern states and his bail conditions should be made stricter.”

This has raised hackles on Jayendrar Swamigal’s side. Attorney Krishnamani has come to Delhi in order to file a counter-affidavit in response to the government.

“Despite making their very best efforts to ensure he doesn’t get bail, the Prosecution has failed. Because of this, that side is at the height of fury! They have plunged into a tone of questioning the Supreme Court itself in some of their briefs! It was only to bolster this that Jayendrar [Swamigal’s] police custody interrogation video scenes were made to air on TV. The police Interrogation Team only have to bear responsibility for those video scenes getting out.

To film video during police custody interrogation is itself a crime, according to the law. Even if such a video were filmed, it should be told to the person undergoing interrogation without concealment. This is a right bestowed by the law upon the accused. But in Jayendrar [Swamigal’s] case, this right was not respected.

Not only that, during custody, Jayendrar [Swamigal] was given some sort of sedative. Because of this, his mental awareness was disturbed. This is obvious from the video itself. The police say that by interrogating via means of ‘narco analysis’, they can extract the truth from the accused. But the court has established in a number of cases that the police should only use what was said in a sound state of mind, where the accused spoke with full mental awareness.

On the basis of all these, we will argue in court that the case against Jayendrar [Swamigal] is false: we have intiated a case in the Chennai High Court to dismiss the case against Him. If the police arrest someone for murder, they have to conduct that case by the book. But what happened in Jayendrar [Swamigal]’s case? Chief Minister Jayalalitha has dramatically declared in the courtroom itself that “I ordered Jayendrar’s arrest with a heavy heart”. This is itself wrong, under the law. Despite her saying this, we can demonstrate illegal actions.

It is clear to see that the government wants to create strife for the Mutt and devastate it. We have made an application to the Supreme Court that the bail provisions should be relaxed and Jayendrar Swamigal should be perform pujas freely according to the Kanchi tradition. We are also mentioning a case of contempt of court by this Tamil Nadu government that defiantly acts against Supreme Court orders.” Krishnamani said in closing.
