Orders on Sundaresa Iyer’s bail petition on January 31

CHENNAI: Orders on the bail petitions of Kanchi Mutt’s former manager Sundaresa Iyer and Kathiravan, a co-accused in the Radhakrishan assault case, will be delivered on January 31 by the Principal Sessions Court here.Principal Sessions Judge P Murugesan reserved his orders on the bail petitions on Thursday after hearing arguments from both sides.
The counsel appearing for Sundaresa Iyer contended that the only allegation against his client was that he was present in the room when the conspiracy to attack Radhakrishnan was hatched.
He argued that the law did not prevent the court from hearing the bail petitions of those who were detained under the Goondas Act.
Further, when the first accused in the case, Jayendra Saraswati, had been granted bail, Sundaresa Iyer could also be released on bail, the counsel said.
However, the prosecution’s contention was that the petitioners were detained under Goondas Act and hence they could not be given bail and, no litigant could approach for a futile order and the court could not be a party to such order.
ANTICIPATORY BAIL: The Kanchi Mutt junior pontiff, Vijayendra Saraswati, on Thursday filed an anticipatory bail petition in the Madras High Court in the Radhakrishnan assault case.
‘‘The petitioner is innocent and there is no evidence whateverso to connect him with the case,’’ the petition said.
