HC reserves order on junior seer bail plea
Pioneer News Service / ChennaiThe Madras High Court on Friday reserved its verdict on the bail petition of the junior Acharya of Kanchi, Sri Vijayendra Saraswati in the Sankararaman murder case, while the police informed the court that he would not be arraigned as an accused in another case relating to an attempt on the life of Radhakrishnan, an associate of the Kanchi Sankara Matt.
Justice M Thanikachalam closely questioned the Public Prosecutor, Mr K Duraiswamy, on the timing of the arrest of Sri Vijayendra and the nature of the materials against him, and wanted him to substantiate the fear that he would tamper with evidence and influence witnesses if released on bail.
At the end of the hearing, Mr Duraiswamy said he was opposing the grant of bail to Sri Vijayendra mainly on the ground that he might 'tamper with witnesses', as he was an 'influential person'.
Mr KS Dinakaran, counsel for Sri Vijayendra, said he would not tamper with evidence if granted bail. The co-accused were all in custody and all documents were in the custody of the police. Even the Supreme Court, while granting bail to the senior Acharya, had imposed only a condition that he should not return to the Mutt until the filing of the chargesheet.
Sri Vijayendra was arrested on January 10, the same day on which the Supreme Court granted bail to the senior pontiff, Sri Jayendra Saraswati, in the same case.
'The Prosecutor submitted that there was no comparison between the situation of the senior and that of the junior.
The Judge reserved his order after hearing the submissions of both sides.
When he took up the anticipatory bail petition of Sri Vijayendra in the Radhakrishnan case, the Prosecutor informed him that the police had no intention to include him in the case. The judge, after ascertaining that Sri Vijayendra would not be arraigned as an accused at all, recorded the prosecution submission and dismissed the advance bail plea on the ground that the 'apprehension of arrest' was misconceived.
