Sankarachaaryaars deny charges of Sankararaman’s murder and plead not guilty
When will the witnesses be examined?
Decision on 17thPondicherry, March 29, 2006
On being framed with charges of involvement in the murder of Sankararaman, the Sankaraachaaryaals denied them and pleaded not guilty. On the coming 17th, it will be decided as to when the Prosecution will start presenting evidence..
Trial
The murder case of Sankararaman, Manager, Kanchipuram Varadharaja Perumal Temple, was being conducted in the Chengalpattu Court. Later the Supreme Court ordered the transfer of this case to Pondicherry court where it is being heard since November last year. In this case the charges were about to be framed on the 20th of last month against the 24 accused including the Kanchi Sanjaraachaaryaals Jeyedrar and Vijayendrar. But the petition filed in the Supreme Court seeking restraint on the appearance of the Public Prosecutors from Tamil Nadu , came up for hearing on 27th. Based on that petition and as per the request of Jayendrar’s counsels that the charge-sheet filling could be done on the next day (28th) the case came up again for hearing before the Pondicherry Principal Sessions Court Judge, Chinna Pandi.
Jeyendrar and Vijayendrar present
All the 24 persons alleged to be involved in this case, including Jeyendrar, Vijayendrar, Sankara Mutt Manager Sundaresa Iyer, Vijayendrar’s brother Raghu, Appu, Kadhiravan were present at the court. Jeyendrar’s counsels, Dinakaran, Lakshman Reddiar, Senthil Narayanan, Sivasubramanian and others argued that the Supreme Court which heard their petition objecting to the appearance of the Public Prosecutor of Tamil Nadu on the government’s behalf, had sought an explanation from the Tamil Nadu Government. To give them time to reply, framing of the charges should be postponed for two weeks.
But the Tamil Nadu Government Public prosecutors Balasundaram, Kandasamy and others
objected to this. They argued that there is no relation between the petition in the Supreme Court and the charge- framing here.Framing of Charges
Accordingly, on the order of the Principal Judge Chinnapandi, the details of charges levelled against all the 24 including Jeyendrar and Vijayendrar, under the relevant sections of Law, were read out.
It was mentioned that the charges pertained to various sections of the Indian Penal Code like 120-B (conspiracy), 302 (Murder), 449 (trespassing into the temple) 213 (accepting money for the crime), 214 (paying money for the crime), 201 (hiding the real perpetrators of the crime), 107 (abetting the murder)
All the 24 accused including Jayendrar and Vijayendrar denied these charges. When Jayendrar spoke, he mentioned, “ I am not at all involved in this case. I have been falsely implicated in this case. I plead not guilty”.
In the same way Vijayendrar also said “this is a false case”. Likewise all the other accused also denied the charges. After framing the charges, the Principal Judge, Chinnapandi, adjourned the hearing to April 14th when a decision would be taken about the date for the Prosecution Evidence
