Premkumar seeks suspension of conviction

MADURAI: The suspended SP, K Premkumar, who had been convicted by the additional district session judge here for allegedly beating and dragging an army man in connection with a property dispute case, when he was sub-inspector in 1982 at Vadipatti, filed a criminal miscellaneous petition before the Madurai Bench of Madras High Court on Wednesday seeking to suspend the conviction.

Premkumar submitted that in the particular case for which judgment was pronounced in 2003, the accused in the counter case also had been convicted. “So it is bad in law”.

The evidence clearly showed that the petitioner or accused (both Premkumar) was innocent and he had not committed any offence as alleging the case and hence in the interest of justice it was necessary that the conviction should be suspended till the disposal of the main case.

The government pleader said Premkumar had repeatedly committed several offences. He had also managed to get promotions despite his wrong actions.

Premkumar’s counsel submitted that both the offences committed by him were bailable offences.

The charges against him were not big enough to issue show cause notice after releasing him under probation of Offenders Act.

The judge Justice M Jeyapaul after hearing both the sides reserved the order.

There was another criminal revision petition filed against Premkumar by Angela Rajan, whose husband and some others were allegedly kept under illegal detention for three days and tortured by Premkumar when he was DSP (Special Branch of Nagercoil district) in 1997.

The CB-CID investigated the case and filed a report against Premkumar and it was quashed by the Judicial Magistrate. The petitioner submitted that the magistrate’s order was vitiated by defects and contrary to law.

The report submitted by the DSP CB-CID was intended to circumvent law and help Premkumar. Justice Jeyapaul ordered issue of notice to ASP Thuckalay and DSP CB-CID Tirunelveli.
