Petition to Transfer Radhakrishnan case Rejected

Chennai: Chennai High Court rejected the petition filed on behalf of Sri Jayendrar in the Radhakrishnan attack case, requesting a transfer to Pondicherry.
Sri Jayendrar, Sri Vijayendrar and 25 others were accused in the Sankararaman murder case. The Supreme Court ordered the transfer of hearings in this case to Pondicherry.
A case accusing Sri Jayendrar and 10 others of having attacked Radhakrishnan, his wife and house servant was filed in Additional Sessions court in Chennai.
Sri Jayendrar had filed a petition with Chennai High court requesting the transfer of this attack case also to Pondicherry. While the hearings on the petition was being conducted, High court had stayed the progress of the case in Sessions court.
The petition was heard by Judge Jayapal and prosecution was represented by M.S.Kandaswamy. After hearing arguments from both sides, the justice issued this statement:
“There is no accusation cited in the petition where it states that justice will not be obtained in Chennai Sessions court. Already there are 370 witnesses to be examined by the Pondicerry Sessions court. If Radhakrishnan case is also transferred then, it will have to take up the task of examining 81 more witnesses. There will be too much burden on this court and the time taken to hear both cases will be very long.
Witnesses in Radhakrishnan case are residing around Kancheepuram area. There is no connection between Sankararaman case and Radhakrishnan case. The accused in both cases are blamed of different charges in each case. Hence, they cannot be handled together. Investigations and collection of evidences were conducted separately for each case. It might not be possible for the witnesses to come to Pondicherry in this case. Hence, the request to transfer this case to Pondicherry is rejected.”
