Further delay likely in serving chargesheet copies
Wednesday March 9 2005 00:00 ISTKANCHEEPURAM: Serving of copies of chargesheet in the Kanchi Sankararaman murder case is likely to be further delayed. On March 10, when all the accused present themselves before the Kancheepuram JM-I court, they will, in all likeliness, be asked to come after a fortnight, sources said.
Following the filing of the 1,873-page chargesheet on January 21, the court had extended the remand of the accused thrice.
When the accused went to the court on February 10, their judicial remand was once again extended.
The further delay could be because the judiciary was yet to examine the document and certify them, the sources added.
On February 10, Special Public Prosecutor (SPP) T Balasundaram had submitted to the court that, as per the provision of the criminal law, the prosecution was willing to present photocopies of the chargesheet to the court and suggested, it would help in the early commencement of the trial.
Reacting to the submission, Magistrate G Uthamaraj said the court would consider the offer.
However, when the SPP reminded the court that it had to commit the case to the Sessions Court within the stipulated period, the magistrate rebuffed the SPP, saying that the court was well aware of its judicial obligations.
Given the fact that already a few weeks had passed, sources said, the court would not take long before committal and that it could be ready by the third week of March.
Once the copies of the chargesheet had been furnished, the process of framing would commence, where the defence and prosecution would argue on the Sections under which the accused had been booked.
After the framing of chargesheet, the magistrate would send the files containing all the documents to the Chengalpattu Sessions Court, where the judge would decide the court of trial.
The court of trial, in all likelihood, would be the Kancheepuram Fast Track Court -II, sources added.
100 HELD: The Kancheepuram police on Tuesday arrested about 100 persons belonging to Tamizhaga Odukkapattor Viduthalai Iyakkam (Movement for Liberation of Oppressed Tamils) for staging a demonstration demanding closure of the Kanchi Sankara mutt.
Advocate Pavendan, who led the agitators, told journalists that the Mutt was promoting casteism and oppressing people from lower strata of society.
