Premkumar complains to ICAI against Gurumurthy

CHENNAI: The Special Investigation Team (SIT), probing the Kancheepuram Sankararaman murder case, has moved the Institute of Chartered Accountants of India (ICAI) demanding action against columnist S Gurumurthy for writing in newspapers without proper authorisation by the Institute, Superintendent of Police K Premkumar has revealed.

In his counter-affidavit filed in the Madras High Court in response to Gurumurthy’s petition seeking the quashing of the criminal complaint filed against him by the SIT, Premkumar also said the Right to Freedom of expression guaranteed under the Constitution would not confer on Gurumurthy any immunity from the IPC or other penal laws as he had wilfully withheld information available with him in the murder case.

Gurumurthy was questioned by the SIT in December last year, following a series of articles he had written in this website’s newspaper about the police investigation. Subsequently, the SIT filed a complaint against him with the Vishnu-Kanchi police station, charging him with withholding vital information when he was questioned on his newspaper assertions.

Responding to Gurumurthy’s prayer for the quashing of the complaint, Premkumar denied that Gurumurthy was threatened with prosecution during the questioning.

Premkumar also defended himself against the charge that he had had a track record of abuse of law and maintained that ever since the investigation against Jayendra Saraswathi began, ‘‘a vicious campaign of misinformation’’ had been unleashed against him.

Premkumar’s counter also referred to some court decisions that went against those who had charged him with violating human rights, but conceded that disciplinary action had been initiated against him following a High Court judgment.

He also recalled that he was awarded the gallantry medal in 1981 for shooting down dacoit Seevalaperi Pandi.

When contacted, Gurumurthy denied all allegations against him and noted that the court was anyway seized of the matter.
