Supreme Court hears Kanchi Shankaracharya case

NEW DELHI: Supreme Court on Monday posted for final disposal the petition filed by Jayendra Saraswathi, Sankaracharya of Kanchi, seeking change of public prosecutor in the Sankararaman murder case, to the last week of January on a non-miscellaneous day, i.e., either on a Tuesday, Wednesday or a Thursday.

A Bench comprising Justice G P Mathur and Justice P Sathasivam passed the orders in this regard after hearing the submissions of senior counsel Fali Nariman for the petitioner and Altaf Ahmed and V G Pragasam for the State of Tamil Nadu.

The question is when a matter is transferred from State A to State B, anybody can be appointed as a public prosecutor, Nariman told the Bench referring to the case of Sankararaman murder in which Sankaracharya is one of the accused and which was transferred from Tamil Nadu to Puducherry. At this the Bench remarked, "You are delaying (the proceedings of the case). "We are not", said Nariman.

After Nariman’s submissions, the Bench noted that there are many instances where only local public prosecutors were appointed after such transfers.

In fact, even in the Best Bakery case also (of Gujarat), a local public prosecutor was appointed (in Maharashtra), the Bench remarked. At this stage, the Bench directed posting of the case for final disposal in the last week of January to be heard on merits.
