Bailable warrant issued against Kanchi Acharya

CHENNAI: A Sessions Court in the city has ordered issuance of a bailable warrant against Kanchi Acharya Jayendra Saraswathy, the prime accused in the Radhakrishnan assault case, for his continuous absence in the court.

First Additional Sessions Judge A R Selvakumar, who issued the warrant on Monday, however, withheld it for a day.

It is learnt that the seer is likely to appear before the judge on Tuesday and the warrant is likely to be recalled.

When the matter was taken up on Monday, eight accused appeared before the judge. The counsel for Appu (lodged in Cuddalore prison) and Kathiravan (in Tiruchy Central prison) informed the judge that they could not be produced before the court due to security reasons arising out of the Chief Minister’s poll campaign in the southern districts.

On behalf of the seer and another main accused Sundaresa Iyer, petitions under Sec 317 of the Cr.PC were filed to dispense with their presence.

Accepting the reason attributed by the counsel for Iyer that he was indisposed, the judge allowed the petition. He, however, rejected Jayendrar’s petition on the ground that he was absent continuously.

While the court respected the seer’s religious commitments, the seer should also reciprocate his responsibility to the court, the judge said, and ordered the issuance of the bailable warrant. The judge, however, kept it in abeyance for a day to enable the Acharya to appear before the court by Tuesday.

The matter was adjourned till April 19.
