High Court Cancels case filed against Gurumurthy

Chennai: The High court today cancelled the case filed by Kanchipuram police against journalist S.Gurumurthy.

S.Gurumurthy had written articles in “The New Indian Express” magazine regarding the police investigation of the Sankararaman murder case.

The police summoned him accusing him of misdirecting the investigation. They filed a criminal case accusing him of hiding the truth and providing insufficient explanation at the questioning.

Gurumurthy had petitioned Chennai High Court to disallow this case. The petition was heard by Judge M.Jayapaul who issued the following statement:

“The police have filed a case against Gurumurthy under section 14 of the Journalist Publishing Code 1867. He cannot be accused of false reporting under this code and they have mistakenly charged him without getting the full facts of the law.

Gurumurthy is expressing his opinions in the newspaper in his capacity as a journalist. Annoyed by his publication, the police have summoned and questioned him.

Even before the article was published, the police had conducted their investigation and arrested the accused in the Sankararaman case. Hence their accusation that he is hiding the truth is not acceptable. Gurumurthy is not obligated to answer questions regarding his article. He is obligated to answer questions related to the Sankararaman investigation, which he has done so.

Some of the police force have made it a habit to provide false information to the press with the intention of creating sensational news, especially when investigating a high profile case. Some journalists courageously publish articles in favor of the victims. The police then files false case with the intention of humiliating the journalist. Gurumurthy has expressed his opinions based on facts obtained from sources. There is no basis for the accusation made by the police. Hence I am dismissing this case filed in the Kanchipuram court.”
